The letter of resignation must be used by an employee leaving his or her job and wishing to inform a responsible person at his or her employer of the effective date of his or her departure.
Unless there is a written agreement to the contrary between the employer and the employee, the latter is not required to respect a minimum notice period, but must give notice of resignation within reasonable time before leaving the company.
In this letter, the employee will confirm that he or she has made the decision to resign freely and voluntarily , and will request that his or her letter of resignation be placed in his or her file, with a copy countersigned by a company official.
In the event of an employee's voluntary resignation, the employer is relieved of its obligation to provide written notice of termination.
However, upon termination of employment, the employer is obliged to pay the employee his regular salary until his departure and, where applicable, to pay any overtime worked and vacation pay to which he is entitled.
